Brain Injury Settlements

Over $12,000,000 Awarded: Head-on collision resulting in traumatic brain injury and fracture/dislocation of the cervical spine

A 16-year-old girl suffered a traumatic brain injury and a fracture/dislocation of her cervical spine in a head-on collision leaving her an incomplete quadriplegic.  The case was settled after a trial on liability by Dale Orlando and Alison Burrison for over $12,000,000.

$12,000,000 Awarded: Rear-end collision resulting in a traumatic brain injury

A 49-year-old husband and father suffered a traumatic brain injury in a rear-end collision.  The case was settled by John McLeish’s team for $12,000,000.

$9,847,500 Awarded: Motor vehicle crash resulting in a severe traumatic brain injury

A 34-year-old husband, father of four and successful systems design engineer was on his way to pick up his children from school when his car was struck and forced off the roadway and into a tree.

As a result of the crash, he suffered a severe traumatic brain injury.  He requires supervision 24 hours a day and rehabilitation support workers to assist him in engaging in meaningful activities.   He is unable to return to his profession and is unemployable.

In the final week before trial, and after a series of negotiations, the defendants significantly increased their offer.  In the end Patrick Brown and Kate Mazzucco settled his claims for $9,847,500.

$6,324,500 Awarded: Mother of two catastrophically injured in a motor vehicle collision

A mother of two was a passenger in a vehicle that lost control on a snow-covered county road and collided with an oncoming tractor-trailer.

As a result of the collision, she sustained a serious traumatic brain injury and numerous fractures including fascial fractures, upper and lower leg fractures, forearm and upper arm fractures, and hand fractures.   As a result of her injuries, she requires 24 hour a day attendant care and extensive physical, cognitive and psychological therapies and support.

Patrick Brown and Josh Nisker successfully sued the driver of the vehicle, the driver of the tractor trailer and the road authority.  They settled the case for $6,324,500.

$5,500,000 Awarded: Passenger suffered a severe traumatic brain injury from a high speed collision

A 39 year old priest suffered a severe traumatic brain injury when he was involved in a high speed collision as a passenger in a car.   The case was settled by Dale Orlando and Alison Burrison on the eve of trial for over $5,500,000.

$4,000,000 Awarded: Ski accident resulting in skull fracture and traumatic brain injury

A 16-year-old boy who was practicing with an international ski team in Colorado fell during a practice run. There was no protective netting on the sides of the course, consequently he slid into adjacent trees.  He fractured his skull and suffered a traumatic brain injury.  The case was settled close to trial by John McLeish’s team for $4,000,000.

$3,600,000 Awarded: Car accident resulting in traumatic brain injury in 19-year-old student

A 19-year-old student was a passenger in a vehicle driven by his best friend, suffered a traumatic brain injury.  The case was settled for $3,600,000.

$3,500,000 Awarded: Pedestrian struck by a car resulting in severe traumatic brain injury

A 15-year-old foster boy suffered a severe traumatic brain injury when he was struck by a car crossing the road against a red light.   The case was settled on the eve of trial by Dale Orlando and Alison Burrison for $3,500,000.

$3,000,000 Awarded: Pedestrian suffered a traumatic brain injury and serious cervical injuries

A  52 year old woman suffered a traumatic brain injury and serious cervical injuries when she was struck by a car, while j-walking across the road .   The case was settled by Dale Orlando and Alison Burrison for $3,000,000.

$2,568,000 Awarded: 6 year old passenger suffered a severe traumatic brain injury after being struck by TTC Bus

A 6 year old girl suffered a severe traumatic brain injury while a passenger in a vehicle which was struck by a Toronto Transit Commission “TTC” Bus.  The case was settled on the eve of trial by Dale Orlando and Joseph Cescon for over $2,568,000.

$2,475,000 Awarded: Man suffered a traumatic brain injury when struck on an e-bike

A 45-year-old man was riding his e-bike on his way home from a tavern when he was struck by a vehicle while riding through an intersection.

As a result of the crash, he sustained a serious traumatic brain injury.   He requires 24 hours a day of supervision and the assistance of rehabilitation support workers and is unemployable.

On behalf of the him and his partner, Patrick Brown sued the tavern, and the driver and owner of the car.   Patrick Brown settled the case for $2,475,000.

$2,350,000 Awarded: 22 year old car accident victim suffered a traumatic brain injury and serious orthopaedic injuries

A  22 year old man suffered a traumatic brain injury and serious orthopaedic injuries when he was ejected from a vehicle involved in a collision.   The case was settled by Dale Orlando and Salvatore Shaw for over $2,350,000.

$1,700,000 Awarded: 12-year-old boy suffers fragmented skull fractures and traumatic brain injury

A 12-year-old boy suffered fragmented skull fractures, and a traumatic brain injury when a 41 pound chunk of asphalt crashed through the front windshield of the car while on the eastbound driving lane of Highway 7/8.  The case was settled by John McLeish’s team for $1,700,000.

$1,300,000 Awarded: 36-year-old pedestrian struck by a car suffered a severe acquired brain injury

A 36-year-old male was a pedestrian waiting for a bus when the defendant driver drove onto the sidewalk and crashed into the bus shelter.  He sustained a severe acquired brain injury.  The case was settled by John McLeish’s team for $1,300,000.

$1,300,000 Awarded: 45 year old man suffered a severe traumatic brain injury when crossing the road

A 45 year old man suffered a severe traumatic brain injury when he was struck by a vehicle as a pedestrian while crossing the street.   The case was settled by Dale Orlando and Joseph Cescon for over $1,300,000.

$1,275,000 Awarded: Township’s failure to use snow fencing results in an 18 year old's TBI

An 18 year old girl suffered a severe traumatic brain injury and significant spinal injuries while a passenger in a vehicle which lost control in part due to snowy roads which resulted from the Township’s failure to use snow fencing. The case was settled on the eve of trial by Dale Orlando and Joseph Cescon for over $1,275,000.

$1,250,000 Awarded: 14 year old boy suffered a severe traumatic brain injury when he was struck by a car

A 14 year old boy suffered a severe traumatic brain injury when he was struck by a car, while walking home with a friend on a country road at night.  The case was settled on the eve of trial by Dale Orlando and Alison Burrison for over $1,250,000.

$1,133,927.37 Awarded: 8 year old girl struck by a vehicle while walking through an intersection

An 8-year-old was struck by a vehicle while she was crossing at an intersection.

As a result of being struck, she sustained a severe traumatic brain injury.  She is, and will continue to be, dependent on considerable attendant care support, medical treatment and therapies.   She will face significant barriers in the workplace.

Patrick Brown settled the case for $1,133,927.37.

$1,100,000 Awarded: 15 month old boy involved in a collision suffered from symptoms consistent with a TBI

An 8-year-old was struck by a vehicle while she was crossing at an intersection.

As a result of being struck, she sustained a severe traumatic brain injury.  She is, and will continue to be, dependent on considerable attendant care support, medical treatment and therapies.   She will face significant barriers in the workplace.

Spinal Cord Injury Settlements

$15,700,000 Awarded: 21-year-old suffered complete quadriplegia after being struck in the back of his head

A 21-year-old male suffered a complete C5 quadriplegia when he was hit by a large billboard sign which struck him in the back of his head. The case was settled by John McLeish’s team for $15,700,000.

Over $10,000,000 Awarded: Gymnastics training session renders a girl an incomplete quadriplegic

A 14-year-old girl suffered a fracture/dislocation of her cervical spine in a gymnastics training session rendering her an incomplete quadriplegic.   The case was settled by Dale Orlando and Alison Burrison for over $10,000,000.

Claim made for $21,000,000: Recreational downhill mountain biking incident where boy was rendered a quadriplegic

A 13-year-old boy became a quadriplegic when he attempted a series of double black diamond table top jumps on a downhill mountain biking run.

After motions before the trial judge and an order striking out the jury along with evidentiary orders, the case settled. The settlement amount is subject to a confidential clause requested by the Defendant. The Claim advanced for the boy  by Patrick Brown was $21,000,000.

$4,600,000 Awarded: Gym class incident results in spinal cord injury and incomplete quadriplegia

An 18-year-old boy suffered a spinal cord injury as a result of a gym class incident leaving him an incomplete quadriplegic.  The case was settled by John McLeish’s team for $4,600,000.

$2,100,000 Awarded: Vehicle struck pedestrian resulting in spinal cord & other injuries

A 39-year-old man suffered injuries to his spinal cord and other injuries as a result of a vehicle striking him while he was a pedestrian. The case was settled by John McLeish’s team for $2,100,000.

$1,000,000 Awarded: 33 year old OPP officer injured when struck by a drunk driver

A 33-year-old OPP officer conducted a road side traffic stop.  While outside of his police cruiser, he was struck by a drunk driver.

As a result of the incident, he sustained cervical spine fractures, cervical and thoracic spine disc bulges and protrusions, left shoulder injuries, and fractures ribs.

Patrick Brown settled the case for $1,000,000.

$2,320,000 Awarded: Car accident results in several injuries including functional arm amputation

A 34-year-old man suffered a right brachial plexus injury which resulted in the functional amputation of his right arm.  He also suffered fractures of his right radius and ulna as a result of a motor vehicle collision.  The case was settled by John McLeish’s team for $2,320,000.

$1,900,000 Awarded: Motorcyclist struck by car resulting in seven serious fractures

A 48-year-old male suffered serious orthopaedic injuries when he was struck by the defendant who made a sudden left turn in front of his motorcycle.  He fractured his right femur, right tibia, both ankles, left scapula and the left collar bone.  The case was settled by John McLeish’s team for $1,900,000.

$1,900,000 Awarded: Pedestrian lost her right leg after she was struck by a vehicle

A female pedestrian was struck by a vehicle,  and pinned between the vehicle and a metal railing.

As s result of being struck she suffered extensive injuries to her right leg which resulted in an above the knee amputation.  She also suffered fractures to her pelvis and a de-gloving injury to her left leg.

Patrick Brown settled her case for $1,900,000.

$1,700,000 Awarded: Head-on collision resulted in multiple orthopaedic injuries

A 41-year-old woman suffered multiple orthopaedic injuries in a head-on collision.  Her case was settled by John McLeish’s team for $1,700,000.

$1,571,500 Awarded: 15 year old girl in a roll-over ATV accident suffers severe injury to hand

Patrick Brown and Kate Mazzucco settled a file for a 15 year old girl in a roll-over ATV accident resulting in an injury to her hand including a three-finger amputation. The case was settled for $1,571,500.

$1,300,000 Awarded: Skier colliding with snowboarder results in 5 orthopaedic injuries including jaw and neck

A 54-year-old woman was skiing when she was struck by a snowboarder. The impact was severe and she sustained injuries to her left shoulder, right knee, left knee, jaw, and neck.  The case was settled by John McLeish’s team for $1,300,000.

$1,100,000 Awarded: 20 year old man suffered a catastrophic injury to his arm requiring amputation

A  20 year old man suffered a catastrophic injury to his arm requiring amputation, while a passenger in a vehicle which lost control in part due to a poorly designed road adjacent a rock cut.   The case was settled by Dale Orlando and Joseph Cescon for over $1,100,000.

$1,085,000 Awarded: Rear-end collision results in multiple orthopaedic fractures

A 28-year-old man suffered multiple orthopaedic fractures to his right elbow, left knee, right ankle, right foot and right tibia in a rear-end collision.  The case was settled by John McLeish’s team for $1,085,000.

$1,080,000 Awarded: 26-year-old suffered a closed head injury as a result of another driver running a red light

A 26-year-old man was struck by the defendant who ran a red light and suffered a closed head injury.  The case was settled before the trial by John McLeish’s team for $1,080,000.

$775,000 Awarded: 41 year old man on an on-ramp injured by a passing transport truck

A 41 year old man was injured when he stopped his vehicle on an on-ramp and was clipped by a passing transport truck.  As a result of the collision, he suffered chronic pain.   The case was settled by Salvatore Shaw on the eve of trial for $775,000.
